To use the Websites [crewmatch.rorc.org] (“Services”), you must agree to our Terms of Use (“Terms”).

The Services are operated by the Royal Ocean Racing Club Ltd, 20 St. James’s Place, London SW1A 1NN (referred to in these Terms as “we” or “us”).

The information you provide:

By registering on our Websites for the Services, you are warranting that all of the information you provide is accurate.

You agree to use your real (legal) name when you register. You will have a choice of how your name should be displayed publicly (e.g. using an abbreviated last name). For that “Display Name” you agree to not use a false name, the name of another person or a name subject to the rights of a person other than you, or a name that is vulgar, obscene or offensive

You must also notify us before registering multiple accounts to prevent being flagged for abuse.

We have no responsibility for any information or material in any form created on and / or uploaded onto our Websites by you or other users whether as part of using our Services or otherwise and  (“Content”).  For the avoidance of doubt Content includes photographic materials.

Be mindful how you use our Services. If you are breaking laws, being obscene, abusing our infrastructure or acting in a manner which is detrimental to our interests, we may exercise our right to withdraw our Services and cancel your registration. 

It is up to you to use caution when visiting any third-party resources we may link to outside of our Websites. They are outside of our control, and we have no responsibility  for any content or actions that result from their use.

Conditions of use of our Services:

You agree that you will not use the Services for any purpose that is prohibited by these Terms of Use.

You agree that you will not contribute Content, in any way, on or through our Services that is unlawful, threatening, abusive or harassing, defamatory, libellous, deceptive or fraudulent, or invasive of another’s privacy. You further agree to not contribute Content that is tortious, offensive, profane, contains or depicts pornography, or is otherwise inappropriate as determined by us in our sole discretion, that  you know is misleading, untruthful, false, or inaccurate, that constitutes unauthorized or unsolicited advertising, impersonates any person or entity, that impersonates any of our employees or representatives or that includes anyone’s identification documents, personal information or sensitive financial information.

You accept and agree that we do not verify in any manner and make no warranty or representation about the accuracy of any Content you access on our Websites or through the Services or any other use or benefit which you make or obtain through the Services or access to the Websites.  We rely on all the users of our Services to comply with these Terms of Use and are unable to ensure compliance. 

You and you alone are responsible for any reliance by you on the Services or other use you make of the Services. You agree that all Content you access by using our Services is at your own risk and we have no responsibility for any damage or loss which you suffer as a result.

You accept responsibility for the acts of others using your account to access our Services as we cannot tell your actions from another’s using your account.

We have no special relationship with you, nor any  duty to you and you acknowledge that your rights in relation to the provision of the Services by us are limited to termination of your account. You agree that we have no duty to take any action regarding which users gain access to the Services, what Content is accessed via the Services or how anyone may use or interpret the Content.

We do not guarantee access to the Services at any time or that the Websites will function as expected. We do not guarantee that access to the Websites or any Content will be restricted in any way or that any information therein will not become publicly available.  

Content provided by us or others may be protected by copyrights, trademarks, patents, service marks, trade secrets or other proprietary rights and laws.

By accessing our Websites and using the Services you agree to indemnify and hold harmless  us and any director, employee or other representative or agent of us against any and all costs, claims, liabilities and expenses of any nature (including legal expenses) which result from any breach or infringement by you of any rights of any third party of any nature whatsoever as a result of your accessing the Websites or using the Services including in relation to any Content provided by you, including (without limitation) claims in respect of intellectual property rights, negligence, harassment or misconduct.     

Prohibited actions

You shall not take any action that may or does impose (as determined by us in our sole discretion) an unreasonably large load on our (or our third-party providers’) infrastructure, or interfere or attempt to interfere with the proper working of the Services or any activities conducted on the Services, bypass or attempt to bypass any measures we may use to restrict or prevent access to the Services (or other accounts, computer systems or networks connected to the Services), add unsolicited advertising or “spam” on the Services, use automated or manual software, devices, use other means to “spider” or “crawl” any page of the Websites or use the Services for high-risk activities including but not limited to any use where the failure of service could lead to personal injury, death or environmental damage.

You shall not decipher, disassemble, decompile, reverse engineer or otherwise attempt to obtain or derive any source code or underlying algorithms or ideas of any part of the Services (including without limitation any application), except for when, where and how applicable laws specifically prohibit such restriction. You shall not modify, or otherwise create derivative works of any part of the Services without express permission.

You shall not use the Services to promote, market, solicit, trade or sell goods or services which are not in our opinion compatible with the Services, these Terms of Use or our policies in relation to the provision of the Services and we reserve the right to require you to cease any such activity in our discretion. 

Rights to Content:

By submitting any Content to the Websites or otherwise as part of your use of the Services you hereby grant to us a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sub-licensable and transferable license to use, reproduce, distribute, prepare derivative works of, display and otherwise fully use such User Content in connection with the Websites, Services and our businesses in any media formats and through any media channels, third party websites and feeds, or technology now known or later developed and including after your termination of your Account or the Services.

You also grant to each other user of the Websites or the Services a perpetual, non-exclusive license to access any of your  Content that is available to the user on the Websites.

The licenses you grant to us and our users do not affect your other ownership or license rights to your Content, including the right to grant additional licenses .

You represent and warrant  that you have the full and unrestricted rights to grant licenses to the Content as provided herein without infringement or violation of any third party rights, including without limitation

• Publicity rights
• Copyrights, trademarks, contract rights, or any other proprietary or intellectual property rights.

Comments, suggestions or other materials sent or transmitted to us (collectively “Feedback”), shall be deemed to be non-confidential.

Subject to the conditions described in our Privacy Policy, we shall be free to use and distribute the Feedback to others without limitation.

We reserve the right to use or publish any responses, questions or comments you email to us for promotional or other purposes without any further permission, notice or payment of any kind to you. All such submissions will be our  property

Confidentiality / Privacy Policy:

We do not share your personal or confidential information with third parties except in relation to delivering  the Services to others or as otherwise agreed by you expressly or in accordance with these Terms & Conditions/Privacy Policy or as required by law.

Compliance with Law:

In using the Services, you must comply with, and refrain from violations of, any right of any other person, entity, law, or contractual duty, including without limitation the laws of England, and including without limitation those laws forbidding

• Distribution of child pornography
• Forgery or Identity theft
• Misdirection or interference with electronic communications
• Invasion of privacy
• Unlawful sending of commercial or non-commercial electronic messages or communications
• Collection of excessive user data from children, or other improper data collection activities
• Securities violations, wire fraud or money laundering
• False advertising
• Propagating or profiting from frauds and unfair schemes

Termination of account:

We reserve the right to refuse, suspend, or terminate your account and/or usage of the website and associated Services and/or to remove profiles and opportunities, at our sole discretion and at any time.

You are free to terminate your account without reason at any time.

Governing Law and Jurisdiction:

These Terms of Use and the provision of the Services, and any non-contractual relationship between you and us shall be construed in accordance with English law and any disputes shall be referred to the exclusive jurisdiction of the English courts.
